The first petition has been filed in the Supreme Court on Friday (April 4, 2025) against the change in the Waqf Act. Congress MP Mohammad Javed has challenged the Waqf Amendment Bill 2025. After passing from the Lok Sabha, the bill was also passed in the Rajya Sabha on Thursday.
Mohammad Javed has described the law as against fundamental rights and religious rights. He has described the Waqf Amendment Act as discriminating against Muslims.
Mohammad Javed is the whip of the Congress party in the Lok Sabha and was also included in the Joint Parliamentary Committee (JPC) created for the Waqf Bill. He says that this law violates Article 14 (right to equality) of the Constitution, 25 (freedom to conduct religion), 26 (freedom of management of religious affairs), 29 (rights of minorities) and 300A (right to property).
The Waqf Amendment Bill has been passed by the Lok Sabha and Rajya Sabha and now the approval of the President is yet to be received. Javed Mohammed has filed a petition through Advocate Anas Tanveer. He says that this law discriminates against Muslims because such restrictions have been imposed in it, which are not present in the arrangements of other religions.
The petition said that when the Hindu and Sikh trusts have been exempted from self-regulation, amending the Waqf Act, 1995, increases the intervention of the states in an inconsistent manner in the affairs of Waqf. Such discrimination is a violation of Article 14. He has also objected to the amendment bill that he has the right to give property to Waqf, which has been at least five years since Islamic practice. He said that this is a violation of Article 25, which gives the right to religion and conduct. The petitioner said that it also discriminates against those who have just adopted Islam and want to give their property to Waqf, this is also a violation of Article 15.
