Questions are constantly raised about the increase in fees in Delhi schools. Recently, questions were raised by parents about the continuous increase in fees and the commercial of education by the Vipaksha. To curb the arbitrariness of schools, the Delhi government has prepared to bring its willing school fee regulation act. Right now this bill is currently in the draft stage and will soon be introduced in the assembly. At present, the draft bill has passed.
Let’s know what are the specialties in this bill
Permission will have to be obtained before increasing the fees: Private schools will have to get permission from the Directorate of Education (DoE) before any type of fee hike. Although these permissions had to be taken earlier also, but earlier these rules applied only to 355 schools which are made on government land. Now with this act, more than 1677 private schools of Delhi will also be covered which are made on the land on unauthorized or leased and were still out of this surveillance.
Earlier there were rules, now preparations to make laws
Earlier DOE’s permission was in the form of notification or guidelines, which was limited to violating. Now a bill has been introduced to legalize it, that is, strict action can also be taken on violations like punishment, recognition and confiscation of management.
How much fees should and how to increase, a process will be made
How the school fees are fixed, how much the school can show in this, how much can be made. Now clear rules will be made for this. Schools will be required to audit your financial records while applying to increase fees. This audit will be done by the Auditors approved by CAG. The most important thing is that now a fee monitoring committee will be formed under the chairmanship of the District Magistrate, which will investigate the audit report, fee structure and complaints of the school.
Penal procedure on arbitrariness will be rigid before before
After the law is enacted by the law, the process of punishment will be different from before. For example, earlier in most cases, only by warning or by imposing a minor fine, which had limited legal validity. But now under the new law, a fine has been fixed from ₹ 1 lakh to ₹ 10 lakh, which can be charged judicial according to the seriousness of the crime.
Recognition will be canceled
If seen, this provision was also present earlier, but only in very serious cases used to be used. Not only this, it could only happen after a long process. Now the bill clearly states that the recognition can be canceled when the guidelines repeatedly disregard and its process will be made sharp and transparent. The rest will tell the time how this law is followed.
Secondly, earlier the management was also under the jurisdiction of the government, it has also been provided in this bill. The truth was that it was used only in very few cases, the reason was that the legal validity of the registration was unclear. But in the new law, this provision has been given concrete in the bill so that the government can take over the schools that continuously violate. That is, now it is not just paper, but the scope of practical implementation is made.
Government is also making the show-cose notice effective
Earlier it was a common process of the Directorate of Education to give show-cose notice, but the schools often ignored it. Now it is being brought under the law so that the next steps of action (eg audit, fine, canceled) can also be added with the notes.
Mental torture or discrimination will also be punished
In the rules that were there till now, there was no strict action on the school in cases like seating children who do not pay fees out of class. But now this behavior will be considered as a legal offense and in such cases a case can be run in the court under human rights violations. If such a complaint is received against a school, then the government will be able to take strict action on it.
