A petition has been filed in the Supreme Court before the President’s consent of the Waqf Amendment Bill passed from Parliament. The petition has been filed by the Congress Lok Sabha MP and the party’s whip Mohammad Javed in the House. Mohammad Javed has told in the petition that he is a doctor by profession. He is also a MP from Kishanganj in Bihar and a member of the Joint Parliamentary Committee (JPC) associated with the Waqf Amendment Bill. The petition filed through advocate Anas Tanveer states that this bill is going to violate many fundamental and constitutional rights. The amended law in the petition has been described against fundamental rights like Article 14, 15 (Equality), 25 (Religious Freedom) 26 (system of religious matters) and 29 (minority rights) of the Constitution. Mohammad Javed has said that trusts associated with other religions have got autonomy in India. He takes a decision on his matters himself. But government interference in Waqf is being increased by passing the amendment bill. The condition of being a Muslim for at least 5 years has also been denied in this petition. The petitioner has said that the Islamic law does not make a difference in how long the person who is wakf is Muslim. In such a situation, the condition being placed through new law directly violates the fundamental right of religious freedom. Apart from this, it will be discriminated against on religious grounds to stop someone recently a Muslim from taking decisions on his property. In this way it is a violation of Article 15. The petition also opposed the place of non -Muslim members in the Waqf Board and the Central Waqf Council. It has been said in the petition that there is no such provision for religious institutions of other religions. People of the same religion run their institutions. If similar rules are not made for other religion, then it will be considered directly to discriminate against Muslims.
